These Terms of Service ("Terms") govern your use of the Purchasa mobile app and related services (the "Service"), operated by Sebastien Beyrak, doing business as Purchasa ("Purchasa," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Purchasa is an AI purchasing assistant. You describe something you want to buy in plain language; an automated agent researches options from third-party merchants and proposes a specific item, price, and merchant. Nothing is bought until you explicitly approve that proposal. Approved purchases are completed using a spend-limited payment instrument issued to your account.
Purchasa is not the seller or manufacturer of anything it buys for you. Every item is sold by an independent third-party merchant. Purchasa acts solely as your purchasing agent — researching, proposing, and (with your approval) executing the transaction on your behalf.
You must be at least 18 years old and able to form a binding contract to use Purchasa. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@purchasa.xyz if you suspect unauthorized use.
Every purchase requires your explicit tap to approve before any charge occurs, whatever the amount. Purchasa does not complete purchases automatically, and there are no spending limits or approval thresholds to configure. A budget you mention in a request (for example, "under $50") guides the agent's research, but it is not a limit on what can be proposed; approving a proposal is the only step that authorizes a purchase. You are solely responsible for reviewing each proposal — including the item, price, and merchant — before approving it. Once you approve a purchase, it is final in the same way any online purchase is final, subject to the individual merchant's own return and refund policies.
The total shown in a proposal is the merchant's own total at the time of the proposal where we could obtain one, and otherwise an estimate. Either way, the amount actually charged is the merchant's total when the order is placed, which can differ because of tax, shipping, or price changes. By approving a purchase, you authorize a charge of up to the approved total plus 15% and US $2, and the payment instrument used for that purchase is capped at that amount. If the merchant's total exceeds it, the purchase is not completed and any funds reserved for it are released back to your balance.
Purchasa is offered on a subscription basis (monthly or annual), billed through the Apple App Store and governed by Apple's own terms. Subscriptions renew automatically until cancelled through your App Store account settings. Fees are non-refundable except as required by law or by Apple's refund policies.
Funds you load into your Purchasa balance, or a payment method you keep on file, are used to pay for approved purchases, including the item price, applicable tax, and shipping. Payment processing is provided by third parties (including Stripe and our card-issuing partner); by using the Service you also agree to their applicable terms.
Purchasa researches publicly available listings and uses automated and third-party tools to evaluate price, reviews, and merchant reputation before making a proposal. Despite these efforts, Purchasa does not guarantee, warrant, or assume responsibility for:
To the maximum extent permitted by law, Purchasa and its officers, employees, and service providers are not liable for any loss, damage, or expense arising from a purchase made through the Service that turns out to be a scam, is not what you wanted, is misrepresented, defective, undelivered, or otherwise unsatisfactory. Your primary recourse for a problem with a specific item is the merchant that sold it, or a dispute filed with the issuer of the payment instrument used, the same as with any other online purchase.
To the fullest extent permitted by law, Purchasa's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the subscription fees you paid in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US $100). In no event will Purchasa be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, even if advised of the possibility of such damages.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AGENT RECOMMENDATION WILL BE ACCURATE OR SUITABLE FOR YOUR NEEDS.
You agree not to use Purchasa to purchase illegal items, to abuse, reverse-engineer, or interfere with the Service, or to use the Service on behalf of anyone other than yourself without authorization.
You agree to indemnify and hold Purchasa harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, a purchase you approved, or your violation of these Terms.
You may stop using the Service and cancel your subscription at any time through the App Store. We may suspend or terminate your account if we reasonably believe you have violated these Terms or where necessary to prevent fraud or abuse.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
